Bie Indenture made the seavonteenth day of Aprill in the tenth yeare in the raigne of our soveraigne Lord Charles by the grace of god of England Scotland  Ffrance and Ireland kinge defender of the faith  Betweene William Allestry of Grayes Inn in the countie of Middlesex Gent and John Buxton of Brassington in the countie of Derby Gent of the one parte and Robert Wilcockson of Over Holoway als Holoway in the parish of Chrich in the said countie of Derby yeoman of the other parte wittnesseth that wheras the right honourable Henry Earle of kent and the Lady Elizabeth his wife by their deeds indented and enrolled in his Majesties Court of kinges Bench at Westminster bearinge date the fifteenth day of May in the Nineth year of the raigne of our soveraigne Lord the king that now is and by other good and sufficient assurances in the law for the consideracon therein expressed did grant  bargaine and sell unto them the said William Allestry and John Buxton and their heires and assignes forever amongst many other thinges therein contained One Messuage ffarme or tenement scituate lyinge and beinge within the towne or hamblet of Over Holoway als Holoway aforesaid then in the occupation of the said Robert Wilcockson or his assignes together with all lande tenement meadows pastures feedinge woodes underwoode liberties priviledges franchesces comons profite comodities emoluamente and hereditamente.therunto belonginge or appertaineinge or ther with all most comonly used occupied set let or enioyed or reputed taken or known as part parcel or member therof as by the same deeds and other assurances wherunto relacon beeing had doth more fully and at large appeare and wheras Thomas Babington of the Burrough of Lecester & squire did also by his deeds indented bearinge date Nineteenth day of June in the said Ninth yeare of his said Maiesties raigne and by other good and sufficient assurances in the law alsoe convey and assure unto them the said William Allestry and John Buxton and their heires amongst many other things therin contained the aforesaid messuage ffarme or tenement in Over Holoway als Holoway aforesaid then in the occupation of the said Robert Wilcockson or his assignes together with all lande with all lande tenemente meadowes pastures feedings woode underwoode liberties priviledges franchisces comons profite comodities emoluamente and heredamente therunto belonginge or appertaineinge or therwith all most comonly use occupied set let or enioyed or reputed taken or known as part parcel or member therof as by the same deed relacon being therunto had doth more at large appeare which said severall assurance and estates was soo made unto them the said William Allestry and John Buxton and their heires at the instance and request of George Spatman of Tannesley in the said countie of Derby yeoman Jeremie Roades of Pleistow in the aforesaid county of Derby yeoman William Tomlinson of Pleystow aforesaid yeoman and Robert Wilcockson of Wheatcroft in the aforesaid countie of Derby yeoman in trust and for the benefit and behoofe of them the said George Spatman Jeremie Roades William Tomlinson and Robert Wilcockson their heires or assignes now these p(rese)ntes doe Wittnesse that they the said William Allestry and John Buxton in discharge of the said trust in them reposed and by the full consent and direction of them the said George Spatman Robert Wilcockson Jeremie Roade & William Tomlinson have granted bargained sold and confirmed and doe by those p(rese)ntes grante bargaine sell and confirm unto the said Robert Wilcockson his heires and his assignes, All the aforesaid Messuage ffarme or tenem(en)t in Over Holoway als Howay aforesaid now in the tenure or occupacon of the aforesaid Robert Wilcockson or his assignes together with all lande tenem(en)te meadows pastures feedings woode underwoode priviledges liberties franchises comons profite comodities emoluamente and hereditm(en)te thereunto belonging or appertaining or therwith all most comonly used occupied set let or enioyed or reputed taken or known as part parcell or member therof, And also usuall wayes and passages for all occasions to and from the said pr(e)misses or any of them by through and over any other of the lande conveyed to the said William Allestry and John Buxton in manner and forme as the said ways and passages have formerly beene reasonably used, Together with all the estate right title interest clayme and demannd what soever of them the said William Allestry and John Buxton or either of them of into or out of the aforesaid p(re)misses or any parte or p(ar)cell thereof, And the revercon and revercons remainder and remainders route and services of the aforesaid p(re)misses every part therof , To have and To hold the aforesaid messuage  ffarme or tenement and all and singular other the p(re)misses every of their appurtenances and every p(ar)te therof unto him the said Robert Wilcockson his heires and assignes for ever To the  onely proper use and behoofe of the said Robert Wilcockson his heires and assignes for ever, to hold of the cheife Lord or Lorde of the fee or fees of the p(re)misses by the route & services therefore due and of right accustomed And the said William Allestry for him and his heires the said messuage ffarme tenem(en)t and all and singular other the p(re)mises heerby granted with every of their appurtenances unto him the said Robert Wilcockson his heires and assignes against him the said William Allestry for him and his heires and assignes shall and will warrant and for ever defend by these pntes And the said John Buxton for him and his heires the said messuage ffarme tenem(en)t and all and singular other the p(re)misses heerby granted with every of their appurtenances unto him the said  Robert Wilcockson his heires and assignees against him the said John Buxton his heires and assignes shall and will warrant and for ever defend by these pntes, And the said William Allestry doth further by the so putes for himselfe his heires executors and administrators covenant promise and grant to and with the said Robert Wilcockson his heires and assignes that the aforesaid messuage ffarme tenem(en)t and all and singular other promises with every of their appurtenance now are and bee and so from time to time and at all times heereafter shall continue and bee unto the said Robert Wilcockson his heires and assignes free and clear and freely and clearly aquited exonerated and discharged or upon reasonable request will and sufficiently saned and kept harmless of and from all former and other bargaines sales guifte grante ioyntures dowers statutes indgmente executons recognizances fines issues amerceamonte debte and duties to the kinge and of and from all other titles trobles charges and incumbrances what so ever had made comitted done or witingly or willingly suffred or consented unto by him the said William Allestry his heires or assignes or by any other person or persons lawfully clayming by from or under him or by his or their meanes assente consents procuremente excepting all grante of ways over the said and the said John Buxton doth alsoe by these pntes for himselfe his heires executors and administrators covenant promise and grant to and with the said Robert Wilcockson his heires and assignes that the aforesaid messuage ffarme or tenem(en)t and all and singular other the p(re)misses with every of their appurtenances now are and bee so from time to time and at all times heereafter shall continue and bee unto the said Robert Wilcockson his heires and assignes free and cleare and freely and clearely acquite exonerated and discharged upon reasonable request well and sufficiently saved and kept harmles of and from all former and other bargaines sales guifte grante ioyntures dowers statues indgmente execucons recognizancesfines yssues and amerceamente debte and dueties to the kinge and of and from titles trobles charges and incumbrances what so ever had made comitted done or wittingly or willingly suffred or contented unto by him the said John Buxton his heires or assignes or by any other person or persons lawfully clayminge by from or under him or by his or their meanes assente consente procuremente excepting all grante of ways over the said and the said William Allestry and John Buxton doe heerby constitute ordaine and make and in their stead and place put Robert Wilcockson of Wheatcroft in the said countyof Derby yeoman & ffrancis Allen of Lea in the said county of Derby yeoman their true and lawful atturneis ioyntly or severally for them and in their names to enter into the said messuage or tenem(en)t and promisses heerby granted or menconed tp be granted and every or any parte therof in name of the wholl p(re)misses herein contained and possession therof or of any parte therof in name of the wholl p(re)misses herein contained to take to the use and behoofe of them the said William Allestry and John Buxton and after such possession and seasin soe taken then peaceable possession and seasin therof or of any part therof in name of the wholl to deliver unto him the said Robert Wilcockson to hold to him and his heires according to the purport of this deed ratiefying whatsoever their said atturnies or either of them shall lawfully doe in the p(re)misses to bee as good and effectuall in the law as though they the said William Allestry and John Buxton performed the same in their owne persons In Wittness wherof the parties above said to these pnts indentures haw interchangably heereunto Memoranda that upon the xxiiiith daye of Aprill 1634 the within named Robert Wilcokson ffrances Allen them made Attorneyes by vertue of the within wrytten letter of Attornes did enter into the said messuage howse within wrytten and peaceable posession and Seyson thereof in the name of all the premisses herein contayned did take to the use of they said William Allestrie and John Buxton. And after such posession & seison thereof soe taken then peaceable posession and seasone thereof in the name of the whole premises herein contayned did deliver unto they said Robert Wilcokson to hould to him & his heires for ever according to the purposte & trewe intention meaning of this within wrytten deed.
