Will of Robert Willcockson of Crich 1649

Line1) In the name of God Amen., twelfth day of September Anno Domini 1649 I Robert Willcockson of Crich in the County of Derby yeoman being but weake in body But of good and perfect

2) remembrance praised bee Almighty God, I do make and ordayne this my last will and testament in manner and forme following, first and principally I bequeath my soule into the hands of .

3) Almighty God my maker trusting by the death Merritts and blood sheddinge of Jesus Christ my saviour so be one of the Number of his elect people to dwell with him after this mortal life in his celestial.

4) and heavenly kingdom for ever more and I bequeath my body to bee buried in the church yard of Crich aforesaid, or else where/whence it shall please the Lord to appoint, And as touching the disposition

5) of all and singular my worldly family goods cattle and chattels and personal estate wherewith God hath blessed me, I will that they shall bee disposed of in the manner and form as followeth

6) Imprinms I give and bequeath unto Richard Willcockson the eldest sonne of my brother Henry Willcockson and to his heirs and assignees for ever, all that moiety or one half of all my Land And.

7) hereditaments in Over Howay (Note: now known as Holloway) with the appurtenances All which is now in the tenure or occupation of Thomas Flint or of his assignees with All the houses edifices Buildings Land meadows commons and como-

8) -odities thereto belongings to have and to hold the same and every part and parcel thereof from and immediately after my decease for ever by those present , he the said Richard Willcockson and his

9) heirs paying unto to his said father Henry Willcockson The yearly sum of twenty shillings of lawful money of England during his natural life him the said Henry Willcockson at two days

10) in the year that is to say at Midsomer and Martlemas (11th Nov.), to begin at which shall happen next after my decease, Item I Give and bequeath unto Stephen Willcockson, my brother Henry Willcockson.

11) his second son and to his heirs and assignees for ever all that other moiety or one half of my land and hereditament in Over Howay aforesaid with the appurtenances all which is now in the tenure or

12) occupation of Lionard Swallowe or of his assignees with all the houses, edifices, building, land meadows commons profits and commodities thereunto belongings to have and to hold the same and every

13) part and parcel thereof from and immediately after my decease for ever by those present, he the said Stephen Willcockson and his heirs paying unto the said father Henry Willcockson the yearly

14) some of twenty shillings of lawfull money of England during the natural life of him the said Henry Willcockson at two days in the year, that is to pay at Midsomer and Martlemas to begin at which

15) Shall happen next after my decease, Item I Give and bequeath to Mary Willcockson now (ie means not 1st wife) my loving wife the some of Three score pounds of good and lawful money of England to be paid

16) to her by my executor out of my goods cattle and chattels within six months next after my decease, and where as my loving wife Mary Willcockson is to (Injoy) the third part of my land in Over Howay aforesaid

17) during her natural life according to the customs of the country after my decease, therefore I give and bequeath unto the said Mary Willcockson my loving wife so much money yearly and during her natural life

18) as shall make up that (which she) shall (receive) from the third (part) of my land as aforesaid, the yearly sum of Tenne pounds of lawful money of England to be paid to her by my executor out of my goods cattle

19) and chattels at two days in the year, that is to say at Midsomer and Martlemas by even portions to begin at which of the said days shall happen next after my decease. Item I give and bequeath

20) Thomas Lowe and John Lowe and Grace Allyn Sons and Daughter unto my wife Mary Willcockson to every one of them Twenty Shillings of lawful money of England to be paid to them by my executor after

21) my decease, Item I give and bequeath unto Thomas Lowe the younger and to Roase Allyn to either of them Twenty Shillings of lawful money of England, Item I give and bequeath unto my loving

22) wife Mary Willcockson the some of Tenne pounds which her brother Raphe Calton now oweth me, Item I give and bequeath unto Elizabeth Willcockson daughter of my brother Henry Willcockson the some

23) of forty pounds of lawful money of England which I will shall be paid by my executor after my decease unto my brother Henry Willcockson and unto my loving cousin Anthony Wood to be put forth and

24) imployed for her best use and advantage and I will that she shall be guided and directed in all things concerning the same according to their good advice and direction and that she shall not match or marry her

25) selfe to any without their consent and good direction, Item I give unto the poor people of Ashover and Crich parishes the sum of forty shillings which shall be paid by my executor unto the overseers.

26) of this my present will, to be distributed according to their good discretions, Item I give and bequeath unto every godchild that I shall have living at my decease Twelve pounds to be paid to them by my

27) executor within six months next after my decease , Item I give and bequeath unto the poor people of the Lea and Howayes within the parishes of Ashover and Crich aforesaid the yearly sum of (five) shillings

28) of lawful money of England which I will shall be paid unto them yearly for ever by the aforesaid Richard Willcockson and Stephen Willcockson equally between them and by their heirs and assignees for ever

29) upon the one and twentieth day of December commonly called St. Thomas’s day the rest of my goods cattle and chattels not hereby bequeathed [I being honestly brought home] and my debts and

30) funeral expenses being paid and discharged out of my whole goods I wholly and absolutely give and bequeath the same and every part and parcel thereof unto my brother Henry

31) Willcockson and unto his sonne Richard Wilcockson and unto his sonne Stephen Willcockson and unto his daughter Elizabeth Willcockson, to be equally divided amongst them all, and

32) hereby I make and ordain my nephew Richard Willcockson aforesaid my true and lawful executor of this my last will and testament to perform the same as I especially trust him, and

33) for overseers of this my present will I nominate and heartily request my brother Henry Willcockson and my cousin Anthony Wood aforesaid to see the same performed as I especially them and

34) I will that they shall have their charges borne when they shall be desired to travel about the performance of this my present will and hereby I revoke all former wills by me made at any time before

35) the writing here of whatsoever, in witness hereof I the said Robert Willcockson have hereunto set my hand and seal dated the day and year first above written
